Skipping a Phase I Can Cost You Far More Than the Report
Environmental contamination doesn’t show up on a standard property inspection. If you close without a Phase I and contamination is later discovered, cleanup costs and deal-impacting liability can land on the current owner, regardless of who caused it.
A Phase I ESA is also the documentation buyers use to support EPA’s All Appropriate Inquiries (AAI) requirement, an important step for qualifying for certain CERCLA landowner liability protections, as long as required steps are taken before acquisition and ongoing obligations are met.
When appropriate, Phase I due diligence is typically performed using ASTM E1527-21 (most commercial properties) and may use ASTM E2247-23 for qualifying rural/forestland properties.

FAQ’S
How long does a Phase I ESA take?
Most Phase I ESAs are completed within 7–14 business days from the time we receive your project information. If you’re working against a closing deadline, let us know early, and we’ll do our best to accommodate your timeline.
Does a Phase I ESA involve any soil or water sampling?
No. A Phase I is entirely non-invasive, no drilling, no sampling, no lab work. It’s a records review and visual inspection only. If sampling is needed based on findings, that moves into Phase II territory.
How long is a Phase I ESA valid?
A Phase I is generally considered current for up to 6 months. If your closing goes beyond that deadline, the Phase I ESA will need to be updated or “refreshed”. “Refreshing” a Phase I ESA typically costs less than the original ESA and can be completed by All Sides as well.
Will my lender accept All Sides Environmental's Phase I ESA report?
Yes. Our Phase I ESAs follow ASTM E1527-21, which most commercial lenders and SBA-backed financing require across Texas. For qualifying rural/large-acreage collateral, we can also complete Phase I work consistent with ASTM E2247-23 when appropriate.
What happens if the Phase I identifies a problem?
If we identify a recognized environmental condition, we’ll explain exactly what it means and whether a Phase II ESA is recommended. Finding something isn’t the end of the deal. It just means you have the information to negotiate or plan accordingly.
