When Wetland Permits Are Required and What They Involve

According to Section 404 of the Clean Water Act, any release of dredged or fill material into U.S. waters, which includes jurisdictional wetlands, is regulated and requires authorization from the Army Corps of Engineers. What Happens When Wetland Impacts Cannot Be Avoided

When project design cannot avoid wetland impacts, mitigation is required to compensate for the loss of wetland functions and values. The sequence of consideration under federal guidance is avoidance, then minimization, then compensatory mitigation, meaning the project must first demonstrate it has done what’s practicable to avoid and minimize before mitigation credit can be applied. Mitigation options in Texas include:

  • Mitigation bank credits: Purchasing credits from a USACE-approved mitigation bank in the same watershed; typically the fastest and most administratively straightforward option
  • In-lieu fee program contributions: Payment into a state or regional program that pools funds to implement larger-scale mitigation projects

Army Corps review of the JD request can take several weeks to months depending on district workload and project complexity. Unauthorized fill in jurisdictional wetlands is a violation of Section 404 of the Clean Water Act and can result in enforcement action by the Army Corps of Engineers or EPA.
